Terms and Conditions of Engagement as an Expert Witness:

Preparation of reports

I, Dr Shahriar Nabili, Consultant Ophthalmologist and Oculoplastic Surgeon, will undertake to supply expert services in accordance with the instructions received from the client and in accordance with the terms set out below.

1. The fee for preparation of a standard medical report is £865.00. The fee for medical negligence report is different and is based on the amount of hours spend on the case. It is charged as £400.00 per hour and an estimate will be provided prior to accepting the instruction.

2. Any further work will incur an additional charge of £400.00 per hour.

3. The Client will agree to settle the account within 3 months from receipt of invoice however I am open to negotiate longer settlement period if agreed in advance.

4. If accounts are not settled within the agreed period, interest will be charged appropriately.

Court Appearances as an Expert Witness

I, Dr Shahriar Nabili, Consultant Ophthalmologist and Oculoplastic Surgeon, will undertake to supply expert services in accordance with the instructions received from the client and in accordance with the terms set out below.

1. Subject to para. 6 below my fee rate is £400.00 per hour for all time spent on the case. I reserve the right to increase this hourly rate on reasonable notice.

2. All reasonable expenses incurred by me will be charged at cost. Any necessary mileage will be charged at 60 pence per mile or first class rail fare, whichever is appropriate. Copies of receipts will be provided if requested.

3. The Client will settle all costs within 30 days from receipt of the invoice.

4. If the case is set down for trial, and is cancelled or settled within 5 working days, one notional day’s attendance at court will be chargeable as set out below.

5. If the case is set down for trial, and is cancelled or settled within 10 working days, 50% of a notional day’s attendance at court will be chargeable as set out below.

6. My daily rate for attending Court Hearings is £3000 per day, including travelling and waiting time, whether or not oral evidence is given.

7. If accounts are not settled within the agreed period, interest will be charged appropriately.
